RingConn Care+ Terms and Conditions

The RingConn Care+ Service (hereinafter referred to as the "Care+ Service") is provided by RingConn LLC (hereinafter referred to as "RingConn" or "we"). Before participating in the RingConn Care+ Service, you must carefully read all the terms and conditions below, especially the text and clauses highlighted in bold. If you do not accept the terms of this contract or have any objections to this contract, please stop the operation immediately. You acknowledge and agree that by checking the box to agree or filling in the information as prompted during the registration or order process and completing the registration or order process, you have fully read, understood, and accepted all the terms and conditions of this contract.

How RingConn Care+ Service Affects Consumer Rights

The benefits provided by the RingConn Care+ Service are supplementary to all rights and remedies stipulated by consumer protection laws and regulations. This service does not impair the rights granted by applicable consumer laws, including the right to obtain warranty remedies under statute, and the right to seek damages when RingConn fails to fulfill its contractual obligations.

1. Care+ Service Contract

1.1 Care+ Service Contract ("Contract") stipulates the services provided by RingConn under the aforementioned contract and includes the terms in this document, as well as your original sales receipt for the contract.
1.2 The benefits of this contract are supplementary to the rights under applicable law, product warranty, and any free technical support. Your contract may be paid for by you or a third party providing financing or payment for the contract ("Contract Payment Provider").
1.3 Scope of Care+ Service
1.3.1 This Care+ Service covers the following devices (collectively referred to as "Covered Devices"): RingConn Gen 2, RingConn Gen 2 Air. The Covered Devices must be new products purchased directly from the Shopify website www.ringconn.com. Any replacement products provided to you by RingConn under Section 3 of this contract are no longer covered by this Care+ Service.
1.3.2 This Care+ Service applies only to your Covered Devices and does not include accessories originally packaged with the Covered Devices. This Care+ Service is not applicable for commercial use. You may not use the Care+ Service to seek any private gain, including but not limited to seeking service for devices owned by others that are not covered by this Care+ Service. You may not sell or transfer any rights under this Care+ Service. Violation of this provision may result in the termination of this Care+ Service.

2. Care+ Service Period and Service Fee

2.1 Care+ Service Period
The Care+ Service period commences from the activation of the Care+ Service (for specific activation procedures, please visit RingConn Care+ Guide.) and continues until the date specified in the Care+ Service Confirmation, unless cancelled ("Care+ Service Period"). The Care+ Service (1-year version) is valid for 365 days, while the Care+ Service (2-year version) is valid for 730 days.
2.2 Care+ Service Fee
The service fee for the Care+ Service (1 year version) is $29.99, and the service fee for the Care+ Service (2 year version) is $49.99.
The above Care+ service fees do not include applicable taxes that you are required to pay.
Please note that the Care+ service fees must be paid in the currency of the country/region where the actual transaction takes place and at the applicable exchange rate of that country/region. Due to differences in exchange rates among different countries/regions, the specific transaction amount shall be based on the amount you actually pay at the time of the transaction.

3.Care+ Service Content

3.1 During the validity of the Care+ Service, you are allowed to request a one-time replacement of the Covered Device (excluding accessories originally packaged with the Covered Device).
Regarding the replacement: We will make reasonable efforts to replace your original Covered Device with a device of the same color and model as your original Covered Device, and with equivalent functionality and features. Additionally, please note that technological advancements beyond our control may sometimes result in the replacement device being priced lower than your original Covered Device. This contract does not provide compensation for such price differences.
3.2 To apply for the replacement service, you will need to pay RingConn a shipping fee of $10.00 per replacement. After successfully applying for the replacement service, RingConn will send you the replacement device.
3.3 Please be aware that once you successfully apply for a replacement device, your original Covered Device will be disabled 30 days after RingConn sends you the replacement device. The disablement will prevent all further use of your original Covered Device. If you believe we have mistakenly disabled your device, please contact RingConn at cs@ringconn.com.
3.4 Service requests submitted and received by RingConn after exiting or terminating the Care+ Service will not be covered under the contract.

4. Care+ Service Scenarios

The following are the coverage scenarios for the Care+ Service. Any costs arising from situations beyond the scope of the service coverage will need to be paid for by you.
The replacement service covers damage or loss to the Covered Device caused by normal use or accidents (including damage or loss of the Covered Device due to human factors, and theft of the Covered Device).
Accessories of the Covered Device are not eligible for the replacement service.

5. Scenarios Not Covered by Care+ Service

Care+ Service does not cover the following losses, costs, and liabilities, and RingConn reserves the right to refuse to provide the service:
(1) Service applications submitted beyond the respective service coverage period;
(2) Failure to apply for the service in accordance with the prescribed service process;
(3) Damage to non-covered devices;
(4) Loss of electronic data stored in the covered device due to unauthorized access or use, or the receipt or transmission of malicious code;
(5) Damage to the covered device caused by natural disasters, war, military actions, riots, coups, terrorist activities, or other similar events;
(6) Damage to the covered device caused by nuclear radiation, nuclear explosion, nuclear contamination, or other radioactive pollution;
(7) Any litigation, arbitration, and related costs associated with the responsibilities of Care+ Service.

6. Service Termination

If any of the following scenarios occur, RingConn reserves the right to unilaterally terminate this agreement without refunding any fees:
(1) The product for which the service is applied was not purchased through official or authorized RingConn channels;
(2) Unauthorized repairs, part replacements, or personal modifications and disassembly of the covered device;
(3) Use of the covered device for illegal or non-compliant activities;
(4) Sale or transfer of the Care+ Service to a third party.

7. Termination of Care+ Service

If any of the following scenarios occur, it shall be deemed that RingConn has fully fulfilled its obligations under the Care+ Service agreement, and the Care+ Service shall be terminated:
(1) The service period stipulated in the Care+ Service agreement has expired;
(2) The number of service instances stipulated in the Care+ Service agreement has been reached;
(3) You voluntarily apply to exit the Care+ Service and it is confirmed by RingConn.

8. Withdrawal and Transfer of Care+ Service

8.1 If your Covered Device is returned in accordance with RingConn's official return policy, you may apply to exit the Care+ Service. After verification by RingConn, you will receive a refund of one hundred percent (100%) of the purchase price you paid for the Care+ Service. If your Covered Device has not been returned or the return application is made after the return period, or if you have already used the replacement service provided by Care+ Service, you will not be able to exit the Care+ Service.
8.2 The Care+ Service is non-transferable. You may not transfer any rights or obligations under this contract. RingConn reserves the right to verify relevant information during the service provision process.

9. Your Obligations

To obtain the Care+ Service under this contract, you agree to (i) provide a copy of the original purchase receipt for your Care+ Service, (ii) provide information on the symptoms and causes of the issues with the Covered Device, (iii) respond to requests for information required for the replacement of the Covered Device, (iv) follow the instructions provided by RingConn, (v) update the software to the current released version before seeking service, and (vi) back up the software and data on the Covered Device.

10. Limitation of Liability

To the maximum extent permitted by applicable law, RingConn and its employees and agents shall not be liable to you or any subsequent owner of the Covered Device for any indirect or consequential damages, including but not limited to the costs of recovery or reproduction of any program or data, failure to maintain the confidentiality of data, or any business losses, profits, revenues, or anticipated savings resulting from RingConn's obligations under this plan.
To the maximum extent permitted by applicable law, the liability of RingConn and its employees and agents to you and any subsequent owner under this contract shall not exceed the original purchase price of this contract.
The benefits granted by this contract are in addition to any rights and remedies provided by consumer laws and regulations. To the extent that these laws and regulations permit limitations of liability, RingConn's liability shall be limited to the provision of replacement services for the Covered Device at its sole discretion.

11. General Terms

(1) RingConn may subcontract or assign the performance of its obligations to third parties, but this shall not relieve it of its obligations to you.
(2) RingConn shall not be liable for any failure or delay in performing the plan due to events beyond its reasonable control.
(3) You are not required to perform preventive maintenance on the Covered Device to obtain service under this contract.
(4) Individuals who have not reached the legal age of majority are not permitted to purchase this Care+ Service.
(5) You agree that any information or data disclosed to RingConn under this contract is not your confidential or proprietary information. Additionally, you agree that RingConn may collect and process data on your behalf in providing the services under this contract. This may include transferring your data to affiliates or service providers in accordance with RingConn's privacy policy.
(6) RingConn has security measures in place to protect your data from unauthorized access or disclosure and illegal destruction.
(7) You understand and agree that by purchasing this Care+ Service, RingConn will use, process, transmit, and protect your information in accordance with the privacy policy provided on the RingConn App. Without prejudice to the foregoing, you agree that RingConn and its affiliates or service providers may use and process your name, device serial number, contact information, repair history, and other personal information related to your Care+ Service, collected or generated by us, our affiliates, or service providers, for the following purposes: (8) To provide and manage the services under this contract and fulfill this contract; (ii) To ensure service quality; and (iii) To communicate with you regarding your contract, related financial transactions, and the services and support provided under this contract. For these purposes, you agree that this may include the transmission of your personal information between RingConn and its affiliates and service providers. 12. Changes to Service Contract Terms and Conditions

RingConn may make changes or adjustments to this contract as appropriate, and any such changes or adjustments will be published on the Care+ Service-related pages. Once published and effective, they will apply to the services provided after the publication.
